TERMS & CONDITIONS

1. Acceptance

(a) These Terms and Conditions (“Terms”) apply to all participants (“you”, “your” or “the participant”) joining any Challenge, program, or service (“Challenge”) provided by CM Empire Pty Ltd (ABN 87 629 622 957) trading as Fight Fit App (“we”, “our”, “us”).

(b) By registering, purchasing, or participating in any Challenge, subscription, or service through the Fight Fit App, you agree to be bound by these Terms.

(c) You must be 18 years or older to participate. If you are under 18, parental or guardian consent is required.


2. Health & Medical Disclaimer

(a) Before beginning any exercise, nutrition, or supplementation program provided through the Fight Fit App, you should consult your physician or qualified health professional to ensure it is suitable for your individual health and fitness condition.

(b) Participation in any Challenge, workout, or nutrition plan is voluntary and at your own risk. Fight Fit App is not responsible for any injury, illness, or health complications arising from your participation.

(c) You acknowledge that physical training and dietary changes carry inherent risks, and you release Fight Fit App, its staff, and affiliates from any liability related to injuries or losses sustained.


3. Account & Eligibility

(a) To participate, you may be required to create an account on the Fight Fit App and provide accurate and up-to-date personal information including your name, contact details, and payment information.

(b) You are responsible for maintaining the confidentiality of your login details and all activity under your account.

(c) We may suspend or terminate your access if false information is provided or if you breach these Terms.


4. Payments & Subscriptions

(a) All payments must be made in full at the time of registration or in accordance with your chosen payment plan. Prices are in Australian Dollars (AUD) and include GST where applicable.

(b) Weekly or monthly subscriptions are billed automatically via your nominated payment method through our secure third-party provider.

(c) Payments are final. Refunds are only available as outlined in section 7 or under Australian Consumer Law.

(d) Failure to make payment may result in suspension or termination of your Challenge access.


5. Challenge Duration, Cancellations & Holds

(a) Each Challenge has a minimum duration (e.g., 6, 8, or 12 weeks). By signing up, you agree to complete the full term.

(b) There is no cooling-off period once your Challenge begins. Refunds or cancellations are not permitted during your minimum commitment term.

(c) Requests to cancel or place your plan on hold must be made in writing to support@fightfitapp.com at least 14 days in advance. Holds are not permitted during an active Challenge period.

(d) You may upgrade your plan at any time. Downgrades are only permitted after your minimum term and at the discretion of the Fight Fit App team.


6. Refunds & Adjustments

(a) We do not offer refunds for change of mind, missed check-ins, or incomplete onboarding.

(b) Errors caused by Fight Fit App (e.g., incorrect plan setup) will be corrected within 2 business days. This does not entitle you to a full refund.

(c) Refunds for one-off services (such as custom plans or eBooks) are only available before delivery of the product or service.

(d) All programs and subscriptions are non-transferable and cannot be resold, shared, or gifted.


7. Winning Cash Prizes

(a) Some Challenges (e.g., 6-Week Challenge) include cash prizes for selected winners.

(b) Winners are chosen by the Fight Fit App judging panel based on:

  • Visible physical transformation through before and after photos submitted on time.
  • Consistency in training, nutrition tracking, and weekly check-ins within the app.
  • Effort, engagement, and discipline throughout the Challenge period.
  • Completion of all required forms, tasks, and check-ins as requested by the Fight Fit App team.

(c) All transformation submissions must be genuine, unedited, and timestamped. Any falsified or manipulated submissions will result in disqualification.

(d) Winners will be announced publicly. Decisions made by the Fight Fit App judging panel are final and not subject to review.


(e) Prize Payments:

  • Cash prizes are paid via electronic transfer to the winner’s nominated Australian bank account within 14 days of the announcement.
  • In some cases, if appropriate, the cash prize may be paid out in full and directly to the winner.
  • Prizes are non-transferable and cannot be exchanged or substituted.

(f) By accepting a prize, winners agree to allow Fight Fit App to use their name, photos, and transformation story for marketing and promotional purposes.


8. Results Disclaimer

(a) Individual results will vary. While our programs are designed to support progress, Fight Fit App makes no guarantee of specific outcomes such as weight loss, muscle gain, or performance improvement.

(b) Results depend on individual effort, lifestyle, and consistency.


9. App Use & Intellectual Property

(a) All content within the Fight Fit App, including workouts, nutrition plans, videos, and written materials, is the exclusive property of CM Empire Pty Ltd.

(b) You may not copy, share, reproduce, or redistribute any content, programs, or materials provided.

(c) The Fight Fit App and all associated digital content are provided “as is.” We do not guarantee uninterrupted access or error-free functionality.

(d) We are not responsible for temporary downtime, technical issues, or data loss beyond our control.


10. Community Conduct

(a) Fight Fit App promotes a positive and respectful community. Any harassment, discrimination, or offensive behaviour towards other participants, coaches, or staff will result in removal from the Challenge without refund.

(b) You agree to engage respectfully in all community channels, including app comments, Facebook groups, or other platforms managed by Fight Fit App.


11. Termination of Access

We may suspend or terminate your access to any Fight Fit App Challenge or service at our discretion if you:

  • Breach these Terms or applicable laws;
  • Engage in dishonest or abusive behaviour; or
  • Act in a manner that harms the Fight Fit community or brand reputation.


12. Marketing, Photography & Media Consent

(a) By participating, you grant Fight Fit App permission to use your name, photos, videos, and transformation results for marketing purposes, including social media, email, and website promotion.

(b) During events or promotional filming, participants may be recorded for marketing use. You may opt out in writing prior to the Challenge ending.


13. Promotions & Discounts

Any promotional offer, referral credit, or discount is subject to change or withdrawal at our discretion. Promotions cannot be combined unless expressly stated.


14. Privacy

(a) We collect and handle your personal information in accordance with the Privacy Act 1988 (Cth) and Australian privacy principles.

(b) Your data is used solely for managing your Challenge, communications, and marketing (where consented).

(c) We use secure, trusted third-party platforms for data and payment processing.


15. Limitation of Liability

(a) To the maximum extent permitted by law, our total liability is limited to the amount you paid for the Challenge or service in question.

(b) We will not be liable for indirect or consequential loss, including lost profits, business, or opportunities.


16. Governing Law & Dispute Resolution

(a) These Terms are governed by the laws of Queensland, Australia.
(b) Any disputes must first be raised in good faith to fightfitapp@gmail.com for internal resolution before pursuing external remedies.
